These requirements are not applied by default and shall apply only if explicitly agreed in writing within the relevant service agreement, offer, or SLA.
Client-Controlled Data and Configurations
For services where the Client retains control over configuration, data placement, integrations, or third-party services, the Client acknowledges that such choices may influence the location and manner of data processing.
In such cases, the Client remains responsible for assessing compliance requirements arising from its own configuration decisions.
Processing on Behalf of Clients
Where networx konnekt it srl processes personal data on behalf of its clients (for example in the context of managed services, cloud services, hosting, or technical operations), it acts as a Data Processor.
In such cases, processing is governed by a dedicated Data Processing Agreement (DPA) in accordance with Article 28 GDPR.

The Client acknowledges and accepts that in order to provide certain services, it may be necessary for networx konnekt it srl to transmit personal or business data to third-party vendors, software providers, cloud platforms, or infrastructure partners.
Such data transfers are limited to what is strictly necessary for service delivery and are performed in accordance with applicable data protection laws.
For client-facing platforms, management panels, or business applications (including ERP, ticketing systems, or similar tools), networx konnekt it srl may process personal data on behalf of the Client and solely in accordance with the Client’s documented instructions.
In such cases, the Client acts as the Data Controller and remains responsible for determining the purposes, legal basis, and scope of the processing, while networx konnekt it srl acts as a Data Processor within the meaning of Article 28 GDPR.
Sub-Processors
NKI may engage sub-processors for the provision of hosting, cloud infrastructure, security, monitoring, communication, accounting, or support services.
Sub-processors are selected based on technical, organizational, and compliance criteria. A current list of relevant sub-processors may be provided upon request where required by law or contract.
